Terms of Service

1. Acceptance of Terms

socialistic.ai (the "Service") is operated by Tinkerland Technology Ltd. ("Tinkerland", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Tinkerland governing your access to and use of the Service. By creating an account, accessing, or using any feature of the Service, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you must not access or use the Service.

2. Service Description and Architecture

The Service provides a platform for publishing Skills (as defined below) as shareable interactive cards and for enabling other users to execute those Skills within conversation sessions. The Service comprises: (a) a web application and API layer hosted on Vercel's serverless infrastructure; (b) agent execution environments ("Goose agents") running on virtual private servers managed by Tinkerland; and (c) authentication, database, and storage services provided by Supabase. The technical architecture may be modified at any time at Tinkerland's sole discretion without prior notice, provided that such modifications do not materially diminish the security protections described herein.

3. Account Registration and Security

Access to certain features of the Service requires authentication via a supported third-party OAuth provider (currently Google or GitHub). You are solely responsible for maintaining the security of your authentication credentials and for all activities that occur under your account, whether or not authorized by you. You must notify us immediately of any unauthorized use of your account. You represent and warrant that you are at least thirteen (13) years of age and have the legal capacity to enter into a binding contract in your jurisdiction.

4. User Content and Intellectual Property

You retain all ownership rights in and to the content you provide through the Service, including without limitation: Skills you publish, API keys you configure, files and links you upload, and messages you submit. By using the Service, you grant Tinkerland a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, display, and transmit your content solely to the extent necessary to operate and provide the Service — for example, displaying your Skill card to the users you share it with and forwarding your messages to the applicable LLM provider. This license terminates when you delete the applicable content or close your account, subject to reasonable backup retention periods.

5. LLM API Keys, Costs, and Security

To enable a Skill for shared use, the creator must provide a valid API key for a supported third-party LLM provider. The creator acknowledges and agrees that: (a) they are solely responsible for all usage, rate limits, quotas, and costs incurred against their API key; (b) the API key is encrypted at rest and is not accessible to Tinkerland personnel, other users, or third parties except as technically necessary for skill execution; and (c) Tinkerland does not proxy, resell, warrant, or guarantee the availability, accuracy, or performance of any third-party LLM service.

6. Third-Party Skills and Disclaimers

Skills available on the Service are created, configured, and published by independent third-party creators, not by Tinkerland. We do not review, audit, endorse, certify, or guarantee the behavior, safety, accuracy, legality, or fitness for purpose of any Skill or its output. The creator is solely and exclusively responsible for: (i) the instructions and configuration of their Skill; (ii) the LLM API key used to power it; (iii) any data-handling, privacy, or security implications arising from the Skill's design and operation; and (iv) compliance with all applicable laws and regulations. 7. Acceptable Use Policy

You agree that you will not use the Service, directly or indirectly, to:

• publish, distribute, or operate a Skill that attacks, phishes, defrauds, or otherwise harms the persons running or interacting with it;
• harvest, collect, scrape, or exfiltrate another user's credentials, personal data, conversations, or any other confidential information;
• generate, store, transmit, or distribute content that is unlawful, sexually exploits minors, incites violence, or constitutes hate speech under applicable law;
• use, abuse, or misappropriate another person's LLM API key, or circumvent rate limits, access controls, or usage quotas imposed by us or any third-party provider;
• probe, scan, test the vulnerability of, scrape, or disrupt the Service or its underlying infrastructure beyond normal, authorized product use.

Tinkerland reserves the right to investigate and take appropriate action in response to any violation of this Section, including without limitation: issuing warnings, suspending or terminating accounts, removing Skills or conversations, and reporting violations to law enforcement authorities where required or appropriate.

8. LLM Output Disclaimer

Skills execute on third-party large language models. The output generated by these models may be inaccurate, incomplete, biased, misleading, or otherwise unsuitable for any particular purpose. You acknowledge and agree that: (a) you are solely responsible for evaluating and independently verifying any information or output received through the Service; (b) Tinkerland does not warrant, represent, or guarantee the correctness, reliability, completeness, or fitness for purpose of any Skill output; and (c) reliance on Skill output is entirely at your own risk.

9. Service Availability and Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TINKERLAND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAY MODIFY, SUSPEND, OR DISCONTINUE ANY FEATURE OR ASPECT OF THE SERVICE AT ANY TIME WITHOUT PRIOR NOTICE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TINKERLAND DISCLAIMS ALL LIABILITY FOR ANY DOWNTIME, DATA LOSS, LOSS OF CONVERSATIONS, OR SERVICE INTERRUPTIONS.

10. Maintenance, Support, and Service Levels

The Service is maintained by Tinkerland on a commercially reasonable, best-effort basis. No service-level agreement (SLA), uptime guarantee, or guaranteed response time is provided. Bug reports and feature requests may be submitted through the contact channels specified in Section 14. Tinkerland will make reasonable efforts to address critical issues in a timely manner but expressly disclaims any obligation to do so. Tinkerland reserves the right to discontinue the Service in whole or in part upon thirty (30) calendar days' prior notice to registered users.

11. Termination

You may delete your Skills and close your account at any time through the Service's user interface. Tinkerland may, at its sole discretion, suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, create a material risk to other users or to the integrity or security of the Service, or as otherwise required by law. Upon termination, we will remove your personal data in accordance with the data retention practices described in our . Privacy Policy

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TINKERLAND, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF TINKERLAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Modifications to These Terms

Tinkerland reserves the right to modify these Terms at any time. If we make a material change, we will update the "Effective" date at the top of this document and, where practicable, provide notice through the Service. Your continued use of the Service after the posting of revised Terms constitutes your binding acceptance of the updated Terms. If you do not agree to any revised Terms, you must discontinue use of the Service.
